6. Access restrictions and enforcement
NZ BritData may, at its discretion, refuse, suspend, restrict, revoke, or terminate access to MyCodeWork Access or connected services where we believe there is misuse, security risk, non-payment, violation of these Terms, violation of third-party platform rules, operational risk, or legal/compliance concern.
We may also review logs, account activity, support records, connected accounts, and technical metadata to investigate abuse, enforce these Terms, protect the service, or comply with legal obligations.
7. Service availability
MyCodeWork Access and related BritData services are provided on an operationally reasonable basis. We do not guarantee that the service will be uninterrupted, error-free, secure against every possible risk, or available at all times.
Maintenance, outages, security incidents, third-party platform changes, infrastructure failures, provider limitations, network issues, updates, or emergency actions may affect availability or functionality.
8. Third-party services
The service may connect to or rely on third-party services, including OAuth providers, Discord, hosting providers, cloud infrastructure, analytics/logging tools, payment processors, communication tools, or security vendors. NZ BritData is not responsible for third-party services, their availability, their rules, their pricing, or their independent processing of data.
Your use of third-party services may be subject to their own terms and policies.
9. User content and submissions
If you submit configuration data, support messages, files, usernames, service details, bot settings, dashboard actions, or other content, you grant NZ BritData a limited right to process that content as needed to provide, secure, operate, support, maintain, and improve the service.
You must ensure that you have the right to submit any content you provide and that your submissions do not violate law, third-party rights, or platform rules.
10. Privacy
Our handling of personal information is described in the Privacy Policy. By using MyCodeWork Access, you acknowledge that information may be collected and processed for authentication, authorisation, security, support, service delivery, audit, compliance, and abuse-prevention purposes.
You can view the Privacy Policy at /privacy.html.
11. Intellectual property
NZ BritData and its licensors retain all rights, title, and interest in MyCodeWork Access, including software, designs, branding, interfaces, documentation, logos, service names, workflows, and related materials. Except as expressly permitted, you must not copy, modify, reverse engineer, resell, sublicense, or exploit any part of the service.
12. Fees and paid services
Some BritData services connected to MyCodeWork Access may be free, paid, trial-based, subscription-based, usage-based, or custom-quoted. Any applicable fees, payment terms, renewal conditions, refund rules, or cancellation rules may be provided separately for the relevant service.
Access to paid or restricted service areas may be suspended or terminated if payment is not received, payment is disputed, abuse is detected, or access is no longer authorised.
13. Disclaimers
To the maximum extent permitted by applicable law, MyCodeWork Access and related services are provided on an “as is” and “as available” basis. NZ BritData disclaims warranties, representations, or guarantees of uninterrupted service, error-free operation, complete security, fitness for a particular purpose, non-infringement, or compatibility with every third-party platform or user environment.
14. Limitation of liability
To the maximum extent permitted by applicable law, NZ BritData will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic losses, including loss of profits, loss of revenue, loss of data, service interruption, reputational damage, loss of goodwill, or loss arising from third-party platforms or providers.
Where liability cannot be excluded by law, NZ BritData’s liability will be limited to the maximum extent permitted by law, including resupply of the relevant service or the amount paid for the affected service during the relevant period, where such limitation is legally available.
15. Indemnity
You agree to indemnify and hold harmless NZ BritData from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of the service, violation of these Terms, violation of law, violation of third-party rights, unauthorised access, harmful submissions, or breach of third-party platform rules.
16. Changes to the service or Terms
NZ BritData may modify, suspend, replace, remove, or discontinue any part of MyCodeWork Access or related services at any time where reasonably necessary for operational, legal, commercial, security, or technical reasons.
We may update these Terms from time to time. Continued use of the service after updated Terms become effective means that you accept the updated Terms.
17. Governing law
Unless a different written agreement applies, these Terms are governed by the laws of New Zealand, without regard to conflict-of-law rules. Mandatory consumer protections or legal rights that cannot be excluded under applicable law remain unaffected.
